Can you be arrested by a bail bondsman? are they part of the police?
If you attempt to skip bail or break the conditions of your contract, you can be arrested by bail bondsmen, even though they are not part of the police. Alternatively, they can have you arrested by the police.
According to the law, accused persons who have had their bail posted by a bond company can be legally arrested /apprehended by bondsmen. Since the accused normally waives their right to refuse the search of any property they may be residing in by the bondsman and their right to a due process during apprehension, bondsmen do not need to possess a search warrant to gain entry into a property during the pursuit of a defendant who has jumped bail.
Other terms, including drug tests and curfews may also be required by a bail bond company as part of their special conditions when posting bail. All these are included in a written agreement.
